TERMS & CONDITIONS OF SALE

Please Note: All attending our auctions agree that they have read and fully understand these terms & conditions and agree to be bound thereby.

Registration: Current positive photo identification or current photo driver’s license. All bidders are required to give us their name, address, and phone number.

Manner of Payment Terms: Cash, travelers check, or approved personal check with prior established business. Cash payment accepted in U.S. dollars only. No Bank Starter Checks Accepted! Title of ownership is retained by seller until instrument of payment has cleared bank.

Business checks or out of Wisconsin checks must be accompanied with a current bank letter, guaranteeing payment to A+ Auctions. (sample letter: __________ is a customer of our bank and we will guarantee payment of checks up to $_____ for purchase at your auction on “Date of Auction”.)

Time of Payment: all items must to be paid for in full by the conclusion of the auction and prior to removal.

Transfers: Transfers of purchases to another bidder before being settled for will not be accepted.

Removal: All items purchased by bidder must be removed on the day of sale, unless prior arrangements have been made with the auctioneer. Removal shall be at the sole expense, liability, and risk of the purchaser. Auctioneer shall not be responsible for goods not removed within the time specified and shall have the option of disposing of said goods at the expense and risk of the purchaser. Purchases will be released only on presentation of paid receipt.

Condition of Items Sold: All items sold in “AS-IS”, ” HOW-IS” & “WHERE-IS” condition with all faults and without recourse. The auctioneer has endeavored to give accurate descriptions and representations, however, the auctioneer and A+ Auctions shall not be responsible for correct description, authenticity, genuineness of, or defect in any item or lot and makes no warranty in connection therewith. No allowances will be made or sale set aside on account of any incorrectness, error in cataloguing, or any imperfection not noted.

Sales: all sales are final.

Buyer’s Responsibility: After you have been declared the successful bidder by the auctioneer, the item (s) become your responsibility at this point even though you may not have yet paid for the item (s). The buyer assumes all risk of loss or damage. Buyers are urged to safe-guard their items accordingly.

Claims: no claims will be allowed by buyer, after goods are removed from premises.

Addition or Withdrawal from Sale: the auctioneer reserves the right to withdraw from sale any of the items listed or to sell at this auction items not listed, and also reserves the right to combine one or more items into one or more selling lots or to subdivide into two or more selling items. The auctioneer reserves the right to sell all of the items in bulk.

Dispute Between Bidders: In the event of a tie bid between more than one bidder, the auctioneer reserves the right at his discretion, to re-open the bidding between the tied bidders. The decision of the auctioneer shall be final and absolute.

Agency: the auctioneer is acting as an agent only and is not responsible for acts of its principals.

Records: the records of sale kept by the auctioneer and book keeper will be taken as final in the event of any dispute.

Reserve: most of our auctions are sold without reserves. On lots upon which there is a reserve, the auctioneer shall have the right to reject any and all bids, and shall have the right to bid on behalf of the seller.

Absentee Bids: Arranged on a per auction basis. We require advance inspection and payment. A+ Auction will not be held liable for errors in, or failure to make such bids. All such bids are subject to our absentee bidding conditions.

Compliance with Terms of Sale: In default of payment of bills in full within the time herein specified, the auctioneer in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages. Lots not paid for and removed within the time specified herein may be resold at public or private sale without further notice, and deficiency, together with all expenses and charges of re-sale, will be charged to the defaulting purchaser.

Non-delivery Responsibility: Auctioneer shall not, in any event, be liable for non-delivery or for any other matter or thing, to any purchaser of any lot, other than for the return to the purchaser of the deposit or sum paid on said lot, should the purchaser be entitled to it.

Buyer’s fee / Bidders fee or Surcharge, (premium): In the event that a buyer’s fee is charged, it will be listed in the terms of the individual auction sale bill. A buyer’s fee is added to the high bid to establish the actual selling price.

Additional Specific Terms: Shall be either listed on individual auction sale bills or announced on auction day. Day of auction announcements will take precedence over all advertised material.

Personal Injury: Auction Attendees / Bidders accept responsibility for any personal injuries and or property damage and also agree to hold the auctioneer / auction service harmless from any personal injuries to themselves or their agents and any property damage incurred on the auction premises.

A “Returned Check” Processing fee: of $25.00 will be assessed for any check returned by the bank for any reason, including NSF (non-sufficient funds). This fee Must be paid (and the payment, if by check, must CLEAR the bank) before the purchaser will be allowed to register as a bidder for any future auction.

Children or Youth, Under the Age of 18 Years Old: Must be accompanied by a parent or legal guardian.

Items Damaged: An auction attendee who breaks or damages an item is responsible to pay for the item at the price which it was sold or at an estimated auction market value based on what similar like items have sold for at auction sales.

Absentee Bid Charges: We charge a 10% handling fee on any absentee bid purchases that have not been picked up and or settled for in full buy the conclusion of the auction.
